Mudita App Store – Terms of Service

The User should carefully review this document. It includes in particular the terms of use for the Mudita App Store, licences, the choice of governing law, and liability rules. However, no provisions of this document affect consumer protection rights granted under mandatory legal regulations. To learn more about your rights, we recommend contacting a local consumer protection organization.
DEFINITIONS
For the purposes of the Terms of Service, the following definitions shall apply:
- App(s) - Any Mudita App(s) or Provider App(s) made available through the Mudita App Store.
- Consumer - A User who is a natural person entering into a contract or other legal transaction with Mudita that is not directly related to their business or professional activity.
- Content - All content, including specifically logos, the app library, descriptions, and other textual, graphic, or multimedia elements posted and distributed by Mudita through the Mudita App Store or entities cooperating with Mudita, including Providers (hereinafter: “Mudita Content”) and Users (hereinafter: “User Content”).
- Minor- A natural person who does not have full legal capacity or a natural person with an equivalent status under the laws applicable in their place of residence. In particular, Minors are considered to be individuals who have not reached the age of 18, subject to the preceding sentence.
- Mudita App - An app made available in the Mudita App Store by Mudita, developed and maintained by Mudita, including all updates, features, components, and elements necessary for its proper functioning. The use of the Mudita App is subject primarily to the terms and conditions set out in any applicable separate agreements, licenses, or other documentation governing such software, and, to the extent not regulated therein, to these Terms of Service.
- Mudita App Store - A software, together with all Content and Updates, as well as any accompanying documentation, provided by Mudita and distributed under the name "Mudita App Store" which the User may use on their end device, including via installation or through a web browser (depending on the available access options)[OW1.1], subject to meeting the conditions specified in the Terms of Service, including the Technical Requirements.
- Mudita - Mudita sp. z o.o. with its registered office in Warsaw (02-607), Jana Czeczota 6 street, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, entry no. 0000467620, Tax Identification Number: 5252558282 and Statistical Identification Number: 146767613, the share capital of PLN: 1,040,000.00, e-mail address: [__], phone number: [__] (charged as a standard phone call in accordance with the operator's tariff plan used by the User).[OW2.1]
- Provider App - An app made available in the Mudita App Store by Provider, the use of which is determined by the Provider and may be set out in separate contractual terms, agreements, licenses, or other Provider documentation.
- Provider - A natural person, legal entity, or organizational unit conducting business activities, other than Mudita, that licenses Provider Apps to Users through the Mudita App Store.
- Technical Requirements - The minimum technical requirements for installing and using the Mudita App Store include: (i) an end device with an Internet connection and sufficient bandwidth to download and the use the Mudita App Store, (ii) where the Mudita App Store is used via installation – and end device running the Android operating system (version [__]) and sufficient device memory/storage, and (iii) where where the Mudita App Store is used via a web browser – a supported web browser, i.e. [__].[OW3.1]
- Terms of Service - This document that specifies the rules for the operation and use of the Mudita App Store, including the terms of providing services electronically.
- Update - Any modified version of the Mudita App Store provided by Mudita. In particular, an Update may include upgrades, enhancements, add-ons, and other modifications to the Mudita App Store, including bug fixes, updates, the addition of new services, as well as functional improvements and refinements.
- User - A natural person who meets the eligibility requirements and uses the Mudita App Store in accordance with the terms and conditions set out in the Terms of Service.
GENERAL PROVISIONS
The Terms of Service specify the rules for the operation and use of the Mudita App Store. Acceptance of the Terms of Service is voluntary, but necessary for the User to use Mudita App Store on their end device. The Terms of Service also apply to any Updates, unless these Updates are governed by another document or agreement, in which case the provisions of that document or agreement will apply.
Mudita App Store may offer Mudita Apps as well as Provider Apps. Provider Apps are made available to the User by the respective Provider, who bears sole responsibility for their functionality, content, and compliance with applicable laws, the content of any offers, and the manner of fulfilling any agreements related to the Provider App. Any complaints or claims concerning Provider Apps should be directed solely to the respective Provider. Mudita is not responsible for Provider Apps.
Apps available within the Mudita App Store may be displayed and sorted according to various criteria, the names of which are indicated within the App Store interface.
Apps may have their own separate terms, agreements, licenses or documentation governing the installation and/or use of an App. The User’s installation and/or use of an App is subject to those terms, as applicable. Where such additional terms apply, the User may be required to accept them before installing and/or using the App.
Minors with limited legal capacity are required to review the Terms of Service with a parent or other legal representative, who must provide valid consent for the Minor to use the Mudita App Store. Mudita has the right to verify that the appropriate consent has been obtained by the User. Minors who do not have full or limited legal capacity or who are not legally permitted to enter into the relevant agreements under the laws applicable in their place of residence are not allowed to use the Mudita App Store.
Use of the Mudita App Store is subject to the User’s device meeting the Technical Requirements. In the event of any non-compliance of the Mudita App Store, including electronic services, with these Terms of Service, the User is obligated to cooperate with Mudita to a reasonable extent to determine whether such non-compliance stems from the characteristics of the User’s digital environment. In the event of non-compliance of the Mudita App Store, including electronic services, with these Terms of Service, the Consumer is entitled to the legal remedies provided for in generally applicable laws.
Services provided through the Mudita App Store are electronic services and, as such, involve typical risks associated with data transmission over the Internet, such as the disclosure of User data, unauthorized access, or data loss. Both parties are obligated to take measures to minimize these risks – Mudita, in particular, by implementing appropriate technical and organizational safeguards, and the User by exercising due care, maintaining data confidentiality, and not sharing it with unauthorized persons.
No provisions of this document affect consumer protection rights granted under mandatory legal regulations. To learn more about your rights, we recommend contacting a local consumer protection organization.
ELECTRONIC SERVICES
Mudita provides Users with the following free of charge electronic services, in particular, in accordance with the Terms of Service:
enabling the creation and use of an account, including its functionalities;
enabling the posting, storage, and distribution of reviews in the Mudita App Store;
enabling access to Content available on the Mudita App Store;
enabling the conclusion of contracts for the Apps.
Users can create an account in the Mudita App Store. To create an account, Users must:
complete the registration form (the scope of the data is determined each time by the form);
review and accept the Terms of Service and Privacy Policy (e.g., by checking the appropriate checkbox);
click the appropriate button to confirm the intention to create an account.
Users may also create an account and log in to an account using external authentication services. The sharing of personal data from the third-party authentication service provider with the Mudita App Store for the purpose of account registration or login is governed by the terms and policies of such third-party provider. The Mudita App Store does not have access to the User’s login credentials (including passwords) used with third-party authentication services.
The User may delete their account at any time by using the appropriate feature within the account (termination of the agreement in this respect) or by sending an email to: [__].
To use electronic services, such as posting reviews and entering into a contract regarding Apps, the User must have an active account and be logged in.
Within the Mudita App Store, the User may download and install Apps on the User’s end device. By clicking an appropriate button or taking an equivalent in-app action, the User enters into a license agreement for the relevant App with Mudita – in the case of a Mudita App or the relevant Provider – in the case of a Provider App. The use of an App may be subject to additional terms (e.g. end-user license agreement), which may be presented to the User within the Mudita App Store interface or within the relevant App.
Agreement for the provision of electronic services:
involving the creation and use of an account – is concluded for an indefinite period when the User clicks the appropriate button to confirm the intention to create an account (confirmation of the conclusion of the agreement is sent to the User’s email address provided during registration);
consisting of the publication of a review – is executed when the review is published in the Mudita App Store;
consisting of viewing Content – is concluded upon the User’s access to the Mudita App Store and remains in effect for the duration of the User’s use of the Mudita App Store, i.e. until the end of the user session.
A Consumer who has entered into a distance contract with Mudita is entitled to withdraw from such a contract within 14 days of the date of its conclusion, in accordance with applicable consumer protection laws. To meet the deadline, it is sufficient for the Consumer to submit a statement of withdrawal from the contract before the deadline expires. The Consumer may submit any unambiguous statement informing of the withdrawal from the distance contract. The statement of withdrawal may be submitted, for example, in writing to the address: [__], or electronically to the email address: [__]. You may use the withdrawal form template provided in Appendix 1 to these Terms of Service, but this is not mandatory.
The right to withdraw from a distance contract, as referred to in Section 3.8 above, does not apply to the Consumer in cases provided for in applicable consumer protection laws, in particular with respect to:
contracts for the provision of services for which the Consumer is obligated to pay a price, if the entrepreneur has fully performed the service with the Consumer’s express and prior consent, and the Consumer was informed of the loss of the right of withdrawal upon performance of the service and acknowledged this;
contracts for the supply of digital content not supplied on a tangible medium, for which the Consumer is obligated to pay the price, if the entrepreneur has commenced performance with the Consumer’s express prior consent, and the Consumer has been informed of the loss of the right of withdrawal upon commencement of performance and has acknowledged this, and the entrepreneur has provided the Consumer with confirmation of the conclusion of the contract.
USER OBLIGATIONS
The User may not (except to the extent expressly permitted by applicable law or expressly authorized by Mudita):
copy, publish, adapt, reproduce, decompile, disassemble, or attempt in any way to determine the source code or any other element of the Mudita App Store;
modify, disable, or bypass any features of the Mudita App Store, any security mechanisms, or create derivative works based on the Mudita App Store;
share, distribute, lease, rent, sublicense, or sell the Mudita App Store;
allow or enable other persons to perform any of the above actions – this also applies to any elements of the Mudita App Store;
download Apps that are not intended for their age group, in accordance with the classification labels provided by the Provider or Mudita;
provide or transmit, through the Mudita App Store, any illegal Content as referred to in Section 6 of the Terms of Service.
The User is particularly obligated to:
use the Mudita App Store in a manner that does not disrupt Mudita's operations or the functioning of the Mudita App Store, in compliance with applicable law, the provisions of the Terms of Service, as well as accepted customs and principles of social coexistence;
refrain from distributing or posting unsolicited commercial information in areas of the Mudita App Store not designated for such purposes, or posting any Content that violates generally applicable laws (prohibition on posting unlawful content);
refrain from conducting IT activities or any other activities aimed at obtaining information not intended for the User, including data of other Users, or interfering with the rules or technical aspects of the Mudita App Store’s operation;
not modify Content provided by Mudita through the Mudita App Store in an unauthorized manner;
provide only true, up-to-date, and necessary User data within the Mudita App Store, and promptly update such data, including personal data, provided to Mudita in connection with the conclusion of the agreement (if applicable).
REVIEWS
A User with an active account and logged into the Mudita App Store may rate and post reviews of Apps in accordance with these Terms of Service. A User may submit only one rating per App and may optionally add one review to such rating.
To submit a rating, the User:
selects the appropriate option on the App’s page and assigns a star rating on a scale of 1 - 5 (1 being the lowest rating, 5 being the highest);
confirms the selection and the intention to publish the rating (and, if applicable, the review – e.g. by clicking the appropriate button).
The User may additionally enter the text of the review in the appropriate field. Adding a review is optional and not a condition for submitting a rating.
The rating and review are published immediately after clicking the appropriate button. Reviews are displayed in chronological order, from newest to oldest. The review is visible in the list of reviews for the App, unless the review publishing feature is disabled on the App’s page. In such a case, the User will be notified of this before or immediately after publication.
The App page displays the arithmetic average of all published and non-deleted ratings for the app.
By submitting a review, the User declares that:
they are the sole author of the review;
they hold all rights to the content of the review, including copyrights, licenses, and consents required by law, enabling the use of the review in accordance with the Terms of Service;
the content of the review does not violate any laws or the legally protected rights of third parties, in particular personal rights and intellectual or industrial property rights;
the content of the review and the rating given represent their honest, subjective impressions regarding the specific application available in the Mudita App Store.
A review must not:
contain illegal Content as referred to in Section 6 of the Terms of Service;
be false or misleading;
contain technically harmful elements, in particular viruses, computer worms, or other potentially harmful software or files.
The User has the right to edit or delete a review they have published at any time. Deleted reviews are not visible in the list of reviews for a given App.
The App Provider or Mudita (in case of Mudita Apps) may provide one response to a User’s published review. The response is visible to all Users on the App’s page. The User is not entitled to respond to the App Provider’s (or Mudita’s) response.
Mudita does not verify whether reviews published in the Mudita App Store were posted by Users who actually used the app in question. Mudita may take action to remove content that violates the Terms of Service, particularly reviews that constitute abuse; however, such actions do not constitute verification of the authenticity of the User’s use of the App.
ILLEGAL CONTENT
The User agrees not to post any User Content (including, in particular, reviews) on the Mudita App Store that constitutes illegal Content. Illegal Content shall be understood to mean Content:
that violates generally applicable laws, is contrary to good morals or the principles of social coexistence (including content that is discriminatory, pornographic, sexually suggestive, or unethical);
containing words generally considered vulgar and offensive;
inciting violence and hatred, promoting violence or other types of illegal activities or illegal products and services;
promoting stimulants (alcohol, nicotine and tobacco products, drugs) and gambling;
violating the rights and personal interests of third parties, in particular intellectual property rights and personal data protection;
containing addresses and links redirecting to external websites and content of a SPAM nature;
violating the provisions of the Terms of Service.
Mudita does not conduct automated verification of illegal Content within the Mudita App Store. Depending on its own discretion, Mudita may carry out voluntary verification activities to detect, identify, and remove illegal content or to prevent access to it.
Any User who has identified actions or information within the Mudita App Store that, in their opinion, constitute illegal Content may notify Mudita of this using the illegal Content reporting mechanism available within the Mudita App Store or via the email address: [__]. The reporting person shall indicate in the notification:
an explanation of the reasons why the reporting person alleges that the reported information constitutes illegal Content;
if required by the report form – the first and last name, email address of the reporting person and the exact electronic location of the information, e.g., the exact URL, and additional information enabling the identification of the illegal Content;
a statement confirming the reporting person’s good-faith belief that the information and allegations contained therein are accurate and complete.
If the reporting person provided their e-mail address in the notification, Mudita will, without undue delay, send the reporting person (i) a confirmation of receipt of the report, and (ii) after reviewing the notification – information on the decision taken.
With respect to a person who has submitted illegal Content, Mudita, in accordance with applicable laws, may in particular:
restrict the visibility of the Content to other Users, including by removing it, preventing access to the Content, or demoting it;
suspend or terminate the provision of the relevant electronic service in whole or in part.
If Mudita has the email address of the person referred to in Section 6.5 above, Mudita will notify that person of the decision imposing the restrictions referred to in Section 6.5 above, along with an explanation.
Mudita may be required to take specific actions regarding illegal Content as a result of an order issued by the relevant authorities. In such a case, Mudita will inform the person to whom the order applies of the order received and of the actions taken in response to that order. Notification will occur no later than at the time the actions are taken in response to the order or at the time specified in the order by the issuing authority.
INTELLECTUAL PROPERTY / LICENSE
All rights, including exclusive rights, to the Mudita App Store and its Content – in particular to graphic elements, logos, names, source code, and database rights – are legally protected and belong to Mudita or entities cooperating with Mudita (including the Provider).
In order to enable the use of the Mudita App Store or the Mudita Content in accordance with these Terms of Service, Mudita grants the User a license to use the Mudita App Store and the Mudita Content without territorial restrictions and solely for the duration of the User’s use of the Mudita App Store or the Mudita Content. This license authorizes the User to temporarily reproduce the Mudita App Store, including the Mudita Content, by displaying it in a web browser or downloading the Mudita App Store to an end device. Any other use of the Mudita App Store and the Mudita Content is permitted only upon Mudita’s express prior consent, which must be given in writing (including electronically) to be valid.
The User acknowledges that the Mudita App Store, including all Mudita Content, may be used solely for personal use and should not be used for commercial purposes.
The license referred to in Section 7.2 above:
does not include: (i) the source code of the Mudita App Store, (ii) any derivative rights, or (iii) the right to make any modifications to the Mudita App Store or the Mudita Content;
is non-exclusive, non-transferable, and indivisible, and does not include the right to grant sublicenses or to transfer any rights to third parties;
does not result in the loss of any rights held by Mudita or its affiliates with respect to the Mudita App Store or the Mudita Content;
Upon posting User Content (in particular reviews) on the Mudita App Store, the User grants Mudita a non-exclusive, royalty-free, and territorially unlimited license to use the User Content posted on the Mudita App Store in accordance with the Terms of Service, in the following fields of exploitation known at the time the license is granted:
with respect to the fixation and reproduction of User Content posted on the Mudita App Store – the production of copies of User Content using specified techniques, including digital techniques, magnetic recording, and printing and reprographic techniques
with respect to the distribution of the original or copies on which User Content posted on the Mudita App Store has been recorded – placing the original or copies of the work on the market;
with respect to the distribution of User Content posted on the Mudita App Store in a manner other than that specified in Section 7.5.2 above – public performance, exhibition, display, reproduction, and broadcasting and rebroadcasting, as well as making User Content publicly available in such a way that anyone may have access to it at a place and time of their choosing, including making User Content available on the Internet, in particular on the Mudita App Store.
The license referred to in Section 7.5 also includes the right to exercise derivative rights to User Content, including the right to use derivative works.
Mudita grants the User a non‑exclusive, non‑transferable, and non‑sublicensable license to install and use the Mudita Apps solely to the extent necessary to use those applications in accordance with their intended purpose and these Terms of Service, unless other documents, license terms, or provisions made available by Mudita provide otherwise.
Use of the Provider App may be subject to additional contractual terms, including, in particular, the license terms specified by the relevant Provider. By installing or using a Provider App, the User may be required to accept a separate end-user license agreement (EULA) or other terms entered into directly with the Provider.
For the avoidance of doubt, Mudita reserves all rights not expressly granted to the User under the Terms of Service. The Mudita App Store is protected under applicable law, in particular copyright law, intellectual property law, and international treaties, including, but not limited to, the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). This license is subject to the restrictions set forth in the Terms of Service.
The User may transfer the license granted under the Terms of Service to third parties only in the event of a transfer of ownership of the User’s end device along with the installed Mudita App Store. Before beginning to use the Mudita App Store, the acquiring User must accept the Terms of Service in the same manner as the transferring User.
UPDATES
Mudita may allow the User to download and install Updates. Mudita will notify (within the Mudita App Store) the User of any available Updates, including those related to security, which are necessary to ensure that the Mudita App Store remains in compliance with the Terms of Service. The User acknowledges that some Updates, particularly those concerning security and resolving security issues reported to Mudita, are crucial for the proper functioning of the Mudita App Store.
If the User does not install the provided Updates, including those related to security, necessary to maintain Mudita App Store's compliance with the Terms of Service and services provided through it, Mudita will not be responsible for any lack of compliance with the Mudita App Store and the services provided, resulting solely from the failure to install such Updates, provided that:
the User has been informed about the need for an update and the consequences of not installing it;
the failure to install or improper installation of the Update was not due to errors in the provided installation instructions.
All components of the Updates are subject to the Terms of Service, unless additional provisions are included through the Update. In the case of an Update requiring a change to the Terms of Service, the provisions of Section 13 shall apply until the modified version of the Terms of Service comes into effect.
LIABILITY
Mudita is obligated to ensure the operation of the Mudita App Store, including the electronic services, in accordance with these Terms of Service. The basis and scope of Mudita’s liability toward Users in connection with the operation of the Mudita App Store are governed by applicable laws, in particular consumer protection regulations.
The User is solely responsible for using the Mudita App Store, including other electronic services, in a manner inconsistent with the applicable law or these Terms of Service.
Mudita may terminate the agreement for the provision of all or selected electronic services referred to in Section 3.1 with immediate effect if the User has violated the Terms of Service or any other provisions binding the User and Mudita regarding the Mudita App Store. In the event of termination of the Terms of Service by Mudita, the User must immediately and completely cease using the Mudita App Store and uninstall it from their end device.
To the fullest extent permitted by law, Mudita shall not be liable for disruptions in the functioning of the Mudita App Store resulting from force majeure, defined as an event that could not have been foreseen and whose consequences could not have been prevented. In the event of force majeure, Mudita shall notify Users of the disruption in access to the Mudita App Store on a case-by-case basis.
The distribution of responsibilities related to the agreement entered into by the User and the Provider through the Mudita App Store is as set out below:
Mudita is solely responsible for providing the Mudita App Store platform and for technically enabling the download of the Provider App. Mudita is not a party to the agreement between the User and the Provider and is not responsible for the performance of such agreement;
the Provider bears sole responsibility for the functionality, security, quality, and content of the Provider App as well as for performance of the agreement with the User, including handling any complaints or claims the User may have in connection with the Provider App.
COMPLAINTS
Complaints regarding issues related to the Mudita App Store and the services provided through it, as covered by the Terms of Service, may be submitted in particular via email to [__] or by mail to the following address: ul. Jana Czeczota 6, 02-607 Warsaw, Poland.
To expedite the complaint resolution process, the complaint should include, in particular:
information on the current Mudita App Store version;
the technical specifications of the device on which Mudita App Store is installed,
contact details (including, if applicable, the User's e-mail address used for downloading the Mudita App Store);
a description of the issue.
Complaints will be processed within 14 days from the date of receipt by Mudita. If Mudita is unable to process the complaint due to missing necessary information, the User will be informed about the missing details. The response to the complaint will be sent to the email address provided in the complaint unless the User requests to receive the response via traditional mail to the specified address.
Complaints regarding Provider Apps (including their functionality and license terms) should be addressed to the relevant Provider as indicated on the App product page.
PERSONAL DATA
Using Mudita App Store may involve the processing of the User's personal data. Detailed information on personal data processing can be found in the Privacy Policy.
DISPUTE RESOLUTION
In the event of any disputes arising directly or indirectly from the Terms of Service, they may first be resolved amicably, including through Mudita’s complaint procedure, if applicable. For Consumers, additional methods specified below may also be available.
The use of out-of-court methods for handling complaints and pursuing claims is voluntary. The following provisions are for informational purposes only and do not constitute an obligation for Mudita to participate in out-of-court dispute resolution procedures. Mudita’s statement regarding consent or refusal to participate in a consumer dispute resolution procedure will be provided in writing or on another durable medium if a dispute remains unresolved following a Consumer’s complaint.
The rules governing out-of-court consumer dispute resolution procedures and the obligations of businesses in this regard are separately defined in applicable laws. Detailed information on the Consumer’s ability to use out-of-court complaint handling and dispute resolution methods, as well as access to such procedures, may be available at the offices and on the websites of relevant consumer protection authorities.
Users of the Mudita App Store, including Users who have reported illegal Content that is the subject of decisions regarding the blocking or suspension of Content available on the Mudita App Store, have the right to choose any alternative dispute resolution body that has been certified by the competent authority.
Any disputes arising from the Terms of Service shall be subject to the jurisdiction of the national courts of Poland or the EU Member State where the user resides, unless mandatory provisions of law state otherwise.
AMENDMENTS
Terms of Service may be amended by Mudita if at least one of the following important reasons occurs:
a change in legal regulations governing functioning of the Mudita App Store and the provision of services through it, as covered by Terms of Service, affecting the mutual rights and obligations of the User and Mudita, or a change in the interpretation of these legal regulations as a result of court rulings, decisions, recommendations, or guidelines issued by the relevant authorities;
a change in the method of functioning of the Mudita App Store and the provision of services through it, as covered by Terms of Service due to technical or technological reasons;
a modification of the scope or method of functioning of the Mudita App Store and the provision of services through it, as covered by Terms of Service, particularly through the introduction of new functionalities, modification, or withdrawal of existing functionalities or services by Mudita;
a modification of the scope or method of service provision by entities cooperating with Mudita, involving the introduction of new functionalities, modification, or withdrawal of existing functionalities or services by these entities, impacting the mutual rights and obligations between the User and Mudita.
Amendments to the Terms of Service shall take effect after a 14-day notice period granted to the User, unless shorter period is required by mandatory legal regulations or decisions of competent authorities or courts.
Continued use of the Mudita App Store, after the amended Terms of Service comes into effect, shall constitute acceptance of the introduced changes. If the User does not wish to accept the modified Terms of Service, they should refrain from using the Mudita App Store and, where applicable, delete their account (by using the appropriate feature within the account or by sending an email to: [__]) and uninstall the Mudita App Store from the User’s end device.
Mudita reserves the right to make changes to the operation of the Mudita App Store, including the services provided through it, that are not necessary to maintain compliance with the agreement and do not lead to its modification (Section 13.1.), when such changes result from:
improvement or modification of existing functionalities, enhancement to the performance of the Mudita App Store, including the services provided through it, in particular through changes to the layout, design, modification of content, and the removal of selected elements;
editorial changes necessary to correct or eliminate errors;
security improvements that do not impact compliance with the agreement, including, in particular, patching exploits and bugs.
Mudita will inform Users of the changes referred to in Section 13.1. within the Mudita App Store and via an email sent to Users, and in the case referred to in Section 13.4, within the Mudita App Store only.
APPLICABLE LAW / LANGUAGE VERSIONS
Terms of Service are governed by Polish law and shall be interpreted in accordance with it, regardless of any applicable conflict-of-laws rules, except in cases where mandatory provisions of the User's jurisdiction provide otherwise.
The parties expressly exclude the application of the provisions of the Convention on Contracts for the International Sale of Goods to these Terms of Service.
The translation has been made in accordance with national requirements, and in the event of any discrepancies between the English version and the translated version, the English version shall prevail, to the extent that such is not prohibited by mandatory legal provisions in the User's jurisdiction.
FINAL PROVISIONS
Terms of Service constitute the entire agreement between the User and Mudita regarding the Mudita App Store, unless expressly stated otherwise in the Terms of Service.
If any provision of these Terms of Service is found to be invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions.
For any questions regarding the content and functionality of the Provider’s App, please contact the Provider (as indicated on the Provider’s App product page in the Mudita App Store).
Mudita is entitled to decide on the complete discontinuation of the Mudita App Store (cessation of operations related to providing access to the Mudita App Store). In such a case, the User will be informed of the decision at least 6 months before the planned discontinuation date (notice period) via a notification displayed within the Mudita App Store, and an email sent to the User's email address provided in the registration form. The User acknowledges that, as a result, certain Apps may no longer be available for download or re-download via the Mudita App Store, which may affect the User’s ability to access Updates or reinstall Apps.
Mudita may terminate the agreement for the provision of all or selected electronic services referred to in Section 3.1 in the event of the circumstances specified in Section 13.1, with a 14-day notice period. A termination notice on this basis will be provided to the User within the Mudita App Store and via an email sent to Users. In that case, depending on the circumstances, the User may need to discontinue the use of the Mudita App Store and uninstall it from the User’s end device.
